The contract between you and Auto Alpha Advisory.

These Terms of Service (“Terms”) are a binding agreement between you (“Customer” or “you”) and Auto Alpha Advisory (registration number: 2025/213512/07) (“we”, “us”, “Auto Alpha Advisory”), a South African advisory firm. They govern your use of this website at autoalphaadvisory.co.za and your purchase of any product or service offered on it (together, the “Service”). By using the website or buying an audit report you confirm you have read, understood, and agreed to these Terms.

1. Parties and entity

Auto Alpha Advisory is a South African advisory firm, registered under registration number 2025/213512/07, with its principal place of business in Cape Town, South Africa. Its sole director and Information Officer is Matt Owen, CA(SA). Auto Alpha Advisory is not a registered VAT vendor; no value-added tax is charged on the fees, and all prices are shown as flat amounts in South African Rand.

2. What we offer

Through this website, Auto Alpha Advisory provides:

  • A free website audit read— an automated score of a website you nominate, across nine domains, delivered on-page and by email;
  • A one-time paid audit report— the full report and prioritised action plan, purchased once (not a subscription) and delivered by email;
  • Free resources— guides and other materials you can request; and
  • Advisory and implementation services— scoped and engaged separately under a written proposal or statement of work, on the terms agreed there.

Our audit uses third-party data sources and APIs. Auto Alpha Advisory does not control, endorse, or warrant the accuracy of any third-party data or service output.

3. Eligibility

To purchase from us you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into a binding contract;
  • If purchasing on behalf of a company or other legal entity, represent that you have the authority to bind that entity to these Terms; and
  • Provide a valid email address and accurate details.

You are responsible for the accuracy of the website address and email you submit. If you believe a purchase was made without your authorisation, contact us at hello@autoalphaadvisory.co.za.

4. Purchases and payment

4.1 Price

The price of the paid audit report is displayed on the audit page before you pay. Auto Alpha Advisory is not a registered VAT vendor; no VAT is added, and the price shown is the full amount payable in South African Rand.

4.2 One-time purchase — no subscription

The audit report is a single, one-time purchase. There is no subscription, no recurring charge, and no auto-renewal. You are charged once, for the report you buy.

4.3 Payment processor

Payment is processed by PayFast. Your card or bank details are entered directly with PayFast and are never stored by Auto Alpha Advisory; PayFast handles all payment-card data under its own PCI-DSS compliance. The charge appears on your statement from PayFast or its nominated entity.

4.4 Delivery

Once payment is confirmed, your full report and action plan are generated and emailed to the address you provide, typically within a short period. If your report does not arrive, contact us at hello@autoalphaadvisory.co.za and we will re-send it.

5. Money-back guarantee and refunds

5.1 Money-back guarantee

The paid audit report carries a money-back guarantee. If you are not satisfied that the report was worth it, reply to the email your report arrived in and request a refund, and we will refund the full purchase price. We may ask for brief feedback so we can improve, but a refund is not conditional on it.

5.2 Billing errors

If you have been charged in error (for example, a duplicate charge), we will refund the incorrect amount within 10 business days of being notified at hello@autoalphaadvisory.co.za.

Nothing in this clause limits your rights under the Consumer Protection Act, 2008 (“CPA”).

6. Acceptable use

You agree not to:

  • Use this website or the audit in a manner intended to harm, mislead, or infringe the rights of third parties;
  • Submit bulk or automated requests, or otherwise abuse the website infrastructure, in a manner that increases our operating costs disproportionately;
  • Resell, sublicense, or redistribute reports or data obtained through the Service to third parties without our prior written consent;
  • Request an audit of a website you are not authorised to have assessed for a purpose that would infringe another party’s rights;
  • Attempt to reverse-engineer, scrape, or copy the Service’s proprietary methodology, scoring, or audit logic;
  • Use the Service for any purpose that violates applicable law, including the Electronic Communications and Transactions Act, 2002, the CPA, or POPIA; or
  • Impersonate another company or individual.

We may decline, suspend, or terminate your access to the Service if we have reasonable grounds to believe you have violated this section.

7. Data ownership and intellectual property

7.1 Your data and your report

You retain ownership of the information you submit (the website address and your contact details). The report we deliver is licensed to you for your own business use; you may share it internally and with your advisers. We process the data you submit solely to produce and deliver your report.

7.2 Our intellectual property

Auto Alpha Advisory retains all rights in: (a) the audit methodology and scoring logic; (b) the audit engine and its underlying code; (c) the report format and design system; and (d) this website and all underlying code.

7.3 Aggregate analytics

We may use de-identified, aggregated data across audits to improve the Service and to publish industry-level insights. Your individual data is never published or shared in identifiable form.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”. We make no warranty, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or that the Service will be error-free or uninterrupted.

The audit report is a measurement and informational tool only and does not constitute investment, legal, regulatory, or professional advice.

9. Limitation of liability and indemnity

To the maximum extent permitted by applicable law:

  • Auto Alpha Advisory’s total aggregate liability to you under or in connection with these Terms (whether in contract, delict, or otherwise) is limited to the total amount you paid to us in the 12 months immediately preceding the event giving rise to the claim;
  • Auto Alpha Advisory is not liable for any indirect, consequential, special, incidental, or punitive loss or damage, including loss of profits, loss of revenue, loss of business opportunity, or reputational harm, even if we have been advised of the possibility of such damages; and
  • Auto Alpha Advisory is not liable for the accuracy, completeness, or availability of any third-party data or service, or for any decision you make based on the data the Service surfaces.

You agree to indemnify and hold harmless Auto Alpha Advisory, its directors, employees, and contractors from any claim, loss, or expense (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your use of the Service in a manner that infringes a third party’s rights; or (c) content you submit to the Service.

Nothing in these Terms excludes or limits liability that cannot be limited under the CPA or any other applicable law.

10. Suspension and termination

We may suspend or terminate your access to the Service immediately if you: (a) materially breach these Terms; (b) engage in conduct that violates Section 6 (Acceptable Use); or (c) use the Service unlawfully. Where you have paid for a report you have not yet received when access is terminated other than for your breach, we will refund that purchase.

11. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms will first be referred to good-faith negotiation by email to hello@autoalphaadvisory.co.za. If not resolved within 30 calendar days, either party may refer the matter to the Western Cape High Court, Cape Town, whose jurisdiction both parties submit to. Nothing in this clause prevents either party from seeking urgent interim relief from any court of competent jurisdiction.

The Consumer Protection Act, 2008 and POPIA apply to the extent required by law and are not excluded by these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The version that applies to your purchase is the one published on this page at the time you buy. The “Last updated” date at the top of this page always reflects the current version.
